Is it possible to get the Samsung Delve without a smart phone plan?

I have Alltel and searches without a smartphone plan. When I got my dive and went to activate it, I said I had to upgrade plans. I called customer support and they told me that the people in the store just trying to make a sale and if I refused to change my plan, there is nothing they can do. I went back to the store, told them that I knew I didn't upgrade, and they had nooo problem activating my new phone with my old project itself. Now, if I use the Internet it only uses my minutes.
